Acceptance of Terms and Customer Accounts
Agreement to these Terms
By creating an account, placing an order, paying an invoice or using any service supplied by VPS Hungary, you confirm that you have read, understood and accepted these Terms, together with any policies referred to in them. If you are accepting on behalf of a company or other organisation, you confirm that you are authorised to bind that organisation, and “you” refers to it as well as to you personally. If you do not agree, you must not order or use our services.
Eligibility
You must be at least 18 years old, or the age of legal majority where you live if that is higher, and legally capable of entering into a contract. You may not use our services if doing so is prohibited by laws that apply to you.
Accurate account information
You agree to provide complete and truthful information when registering, including your name, a working email address and billing details, and to keep them up to date in the client area. Accounts opened with false, incomplete or misleading details may be refused, suspended or closed without refund. We may review new orders before activation and ask for further information to prevent fraud; an order may be declined at our discretion, in which case any payment received for it is returned.
Responsibility for your account
You are responsible for all activity carried out through your account and on your services, whether by you, your staff, your own customers or anyone else who obtains access. Keep your client area password and server credentials confidential, and tell us promptly if you believe they have been compromised. We may require identity verification before acting on sensitive requests such as ownership changes, service transfers or reinstallation.
Communications
We communicate primarily by email and through support tickets. Notices sent to the email address registered on your account are treated as received by you. Important notices about billing, suspension, abuse or changes to these Terms are sent this way.
Description of Services and Provisioning Times
- What we provide
VPS Hungary supplies virtual private servers built on KVM virtualization and dedicated (bare metal) servers housed in a Tier III certified data centre in Budapest, Hungary, together with optional add-ons such as additional IPv4 addresses, control panel licences, paid management and paid backups. The specification of each plan, including vCPU or processor model, RAM, storage, traffic allowance and port speed, is the one published on our website at the time of your order.
- Unmanaged by default
All services are provided on an unmanaged basis unless you purchase a paid management add-on. This means we are responsible for the underlying hardware, the virtualization layer, power, cooling and network connectivity up to your server. You are responsible for everything inside the operating system, including installation and configuration of software, updates and security patches, firewall rules, user accounts, and the content and applications you run. Our support team can carry out platform-level tasks such as hard reboots, reinstallation and reverse DNS changes on request.
- Provisioning times
Orders are processed in the order in which they are received and paid. A VPS is normally delivered within 1 to 6 hours after payment is confirmed. A dedicated server is normally delivered within 24 to 72 hours, because hardware must be prepared, tested and installed with your chosen operating system. These are typical timeframes, not guarantees; delays can occur during high demand, fraud review, or when a specific component must be sourced.
- IP addresses
IP addresses assigned to your service remain the property of the Provider or its upstream networks. They are allocated for use only while your service is active and paid. We may need to change an IP address for technical, network or legal reasons and will give notice where reasonably possible.
- Plan changes
To move a VPS to a larger plan, you order the new plan, migrate your own data and cancel the old service before its renewal date. Additional resources can be added to most dedicated server configurations by request, at the price quoted at that time.
Acceptable Use Policy and Prohibited Activities
You may use our servers for any lawful purpose, including websites, mail servers, databases, VPN and proxy services, development and staging environments, game servers and automated trading software. In return, you must not use them, or allow others to use them, in any way that harms our network, other customers or third parties. The following activities are prohibited.
Prohibited activities
- Spam. Sending unsolicited bulk email or messages, operating open mail relays, hosting sites advertised by spam, or using purchased or harvested mailing lists.
- Network attacks. Denial-of-service attacks, port scanning or vulnerability scanning of systems you are not authorised to test, brute-force login attempts, packet flooding, and any attempt to gain unauthorised access to other systems.
- Malware and phishing. Distributing viruses, ransomware, botnet controllers or other malicious code, and hosting phishing pages or fraudulent websites.
- Illegal content. Storing or distributing material that is unlawful, including child sexual abuse material, which will be reported to the relevant authorities, and content that infringes copyright, trademarks or other intellectual property rights.
- IP abuse. Using IP addresses not assigned to you, spoofing source addresses, or obtaining additional IPs under false pretences.
- Resource abuse. Activity that degrades the platform for other users, such as sustained loads that interfere with shared host nodes.
Proxy and VPN services
If you run a proxy, VPN or similar service that relays traffic for other people, you are fully responsible for that traffic. You must maintain reasonable controls to prevent abuse and respond to complaints about it.
Enforcement
We investigate abuse reports and may act on them without prior notice where the activity is serious, ongoing or unlawful. Actions include filtering traffic, null-routing an IP address, suspending a service, or terminating the account. Accounts terminated for abuse are not eligible for any refund. You agree to cooperate with abuse investigations and to resolve issues promptly when notified.
Backups are your responsibility
Unless you have purchased a paid backup service, we do not back up your data. You must keep your own regular backups stored off the server. We are not liable for data loss for any reason, including hardware failure, reinstallation, suspension, termination or your own errors.
Billing, Payments, Suspension and Refunds
Billing cycle
Services are billed monthly in advance. There are no long-term contracts; each month’s invoice covers the following service period. Invoices are generated before the due date and sent to your registered email address, and are also available in the client area. Prices are stated in US dollars and are those shown on our website or in a written quote at the time of ordering. Any taxes, currency conversion costs or payment provider fees that apply to you are your responsibility.
Payment methods
We accept payment through PayPal and through Bitcoin and other supported cryptocurrencies. Payment is considered received only when the funds are credited to us; for cryptocurrency this means after the required network confirmations.
Late payment and suspension
If an invoice remains unpaid after its due date, the related service may be suspended automatically. Suspended services that remain unpaid may then be terminated and their data permanently deleted. We cannot guarantee that data will remain available once a service has been terminated for non-payment. Restoring a suspended service requires payment of all outstanding invoices.
Disputes and chargebacks
If you believe a charge is incorrect, contact our Billing department first so that we can resolve it. Opening a payment dispute or chargeback without contacting us may result in immediate suspension of all services on the account until the matter is settled, and we may recover any associated fees.
Refunds
VPS Hungary does not offer a money-back guarantee. Because servers are provisioned and resources allocated to you immediately, payments are generally non-refundable, including for partial months, unused time, add-ons and setup work. Refunds are not a standard part of our service and may be granted only at the Provider’s sole discretion, for example where we are unable to deliver an order at all.
Cancellation
You may cancel a service at any time by submitting a cancellation request from the client area. To avoid being invoiced for the next period, request cancellation before the renewal date. Cancellation takes effect at the end of the paid period or immediately, as you choose, and does not create a right to a refund.
Windows Evaluation Licensing and Third-Party Software
Where a plan supports Windows, we can install Windows Server 2016 or Windows Server 2019 as an unlicensed evaluation (trial) edition.
Windows Server evaluation editions
Where a plan supports Windows, we can install Windows Server 2016 or Windows Server 2019 as an unlicensed evaluation (trial) edition. Evaluation editions are published by Microsoft for testing purposes and typically run for around 180 days, after which they may restart periodically, display activation warnings or restrict functionality according to Microsoft’s own rules. We do not supply a Windows licence as part of the standard service, and no plan includes a free licence.
You are responsible for ensuring that your use of Windows complies with Microsoft’s licence terms. If you intend to use Windows beyond evaluation, in production, or for commercial purposes requiring a licence, you must activate the server with a valid licence that you obtain and that is permitted for use on hosted or virtualized infrastructure. We are not responsible for loss of service or data caused by the expiry of an evaluation period. The smallest VPS plan, VPH1, supports Linux only. Linux distributions
Linux images such as AlmaLinux and other RHEL-family systems, Ubuntu, Debian and Fedora are provided as distributed by their respective projects under their own open-source licences. We do not guarantee that any distribution will continue to receive updates from its maintainers, and you are responsible for keeping your operating system current.
Control panels and add-on software
Control panels and other software we offer as paid add-ons, such as cPanel/WHM, Plesk Obsidian, DirectAdmin, ISPmanager Lite, Virtualmin or VestaCP, are supplied subject to their vendors’ licence terms, which you agree to follow. Licence prices are set by the vendors and may change; if a vendor increases its price, we may adjust the add-on fee with notice.
Software you install
You are solely responsible for licensing any software you install yourself, and for ensuring that its use is lawful. We may suspend a service if we receive a credible complaint that unlicensed or pirated software is being used or distributed from it.
Service Levels, Uptime Target and Maintenance
Uptime target
We aim for 99.9% network and infrastructure availability, measured over a calendar month, for the hardware, power and network that we control. This is a service objective that guides how we operate the platform rather than an unconditional guarantee. It covers the availability of the host node or dedicated hardware and its network connection, not the software, applications or configuration inside your server.
What the target does not cover
- Scheduled maintenance announced in advance.
- Emergency maintenance needed to address security threats or prevent wider failures.
- Problems caused by your own software, configuration, resource usage or actions, including reboots and reinstalls you request.
- Suspension for non-payment or for breach of these Terms.
- Denial-of-service attacks or other events that exceed the basic DDoS and intrusion protection on our network.
- Failures of third-party networks, upstream carriers or the wider internet beyond our control.
- Events outside our reasonable control, as described in the liability section.
Maintenance
We carry out maintenance from time to time to keep hardware, virtualization software and the network secure and reliable. Where practical, planned work is scheduled for low-traffic periods and announced by email or in the client area beforehand. Emergency work may take place without notice when delay would put services at risk.
Hardware replacement for dedicated servers
If a component in a dedicated server fails because of a hardware fault, we will replace the failed part free of charge, subject to parts availability. Replacement times depend on the nature of the fault and the work required in the data centre. Hardware replacement does not include data recovery; if a disk fails, data on it may be lost, which is why your own backups are essential.
Reporting an outage
If your service appears to be unavailable, open a support ticket with the server details and the results of any tests you have run. Our team works 24/7 and treats availability issues as a priority.
Remedies
Where a significant outage is caused by a failure within our control, we may, at our discretion, offer account credit proportionate to the downtime.
Termination, Limitation of Liability and Governing Law
Termination
You may end a service at any time by cancelling it from the client area. We may suspend or terminate a service, or your whole account, if you breach these Terms, fail to pay, provide false information, engage in fraud or abuse, or if we are required to by law. In serious cases, termination may be immediate and without notice. After termination, your data will be deleted and cannot be recovered, so make sure you have retrieved anything you need beforehand. No refund is due on termination for breach.
Limitation of liability
To the maximum extent permitted by law, the Provider is not liable for indirect, incidental, special or consequential losses, including loss of profits, revenue, business, goodwill or data, arising from your use of, or inability to use, our services. Our total liability for any claim relating to a service is limited to the amount you paid for that service in the three months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded.
Indemnity
You agree to indemnify and hold harmless the Provider against claims, losses and costs, including reasonable legal fees, arising from your use of the services, the content you host, or your breach of these Terms or applicable law.
Events beyond our control
We are not responsible for failure or delay caused by events outside our reasonable control, including natural disasters, power grid failures, actions of governments or authorities, wide-scale network attacks, and failures of suppliers or upstream carriers.
Changes to these Terms
We may update these Terms from time to time. The current version is always published on this page, and material changes are notified by email or in the client area. Continuing to use the services after changes take effect means you accept the updated Terms.
Governing law and general provisions
These Terms are governed by the laws of the jurisdiction in which the company operating VPS Hungary is registered, and the courts of that jurisdiction have jurisdiction over any dispute. If any provision is found unenforceable, the remainder stays in effect.
